MACIAS BILL GIVES KENDALL COUNTY CITIZENS A VOICE

Austin, TX - Representative Macias is filing legislation that would allow the citizens of Kendall County to vote on granting the Commissioners' Court limited authority to manage growth and protect historical structures.

"This bill is very different from the proposed new rules and regulations for the unincorporated areas of Kendall County that Gene Miertschin submitted in January," said Macias. "That proposed legislation granted full zoning control to the county and I believe it was not in keeping with our Texas respect for private property and the rural traditions of the Hill Country. Miertschin's proposal also would restrict economic development and impinge on the City of Boerne's ability to manage development within its ETJ. These controls would require additional county government staffing to properly administer. I believe my proposal allows Kendall County voters to address the specific challenges of rapid growth and preserve the beauty and culture of the Hill Country."

Macias stated, "The Miertschin proposal also controlled the location, numbers, height, and size of buildings and structures. Many Kendall County residents were very uncomfortable with these controls and their impact on the rights of property owners. The legislation I have introduced allows the county, through its citizens, to manage development of platted residential subdivisions."

Kendall County Judge Gaylan Schroeder said, "This is a complex issue; I am pleased that Representative Macias has clearly put in a great deal of effort to craft legislation that meets our needs without compromising the rights of property owners."
